Ownership of Goods

The product shall remain the sole and absolute property of Gym Gear, until such times as the customer shall have paid the agreed price, together with the full price of any products subject to any other contract with Gym Gear.

Gym Gear reserves the immediate right of possession of any goods to which it has retained the title as aforesaid, which rights shall be exercisable if the customer has become unable to pay its debts as they fall due. For this purpose the customer grants an irrevocable right and licence to Gym Gear, its servants and agents to enter its premises, with or without vehicles, during normal office hours and thereafter. Gym Gear reserves the right to re-distribute the products.

Claims

Any shortage, damage or discrepancy against shipments must be detailed in writing, together with a copy of the packaging list, to Gym Gear within 7 days of receipt of goods. All claims for goods lost in transit must be received by Gym Gear within 7 days of dispatch of Gym Gear invoice for such goods. Claims cannot be considered after this time.

Return of Goods

Goods will only be accepted for return under the following conditions provided they have not been specially ordered and manufactured. Prior to returning goods, telephone authorisation must be obtained within 14 days of receipt of goods. Goods must then be returned within 14 working days from the date the customer informed Gym Gear they wanted to return the goods. The delivery note / invoice number must be included on the return advice. The goods must be in their original packaging, in a clean, resalable condition.

Gym Gear will not be responsible for return postage and packing unless the goods are faulty or incorrectly supplied. Except when goods are faulty or incorrectly supplied all returned goods will be subject to a 20% handling charge, with a minimum charge of £10 plus VAT to cover administration costs. If the packaging is damaged an additional cost flat rate of £2.50 plus VAT will apply to cover repacking costs.

International Shipping, Customs and Import Charges

Orders delivered outside of the United Kingdom may be subject to import duties, customs charges, local taxes, clearance fees, and other charges imposed by the destination country. Unless otherwise agreed in writing, these charges are the sole responsibility of the customer and are not included within the product price or shipping costs quoted by Gym Gear.

The customer is responsible for ensuring compliance with all applicable import laws and regulations within the destination country.

Gym Gear shall not be responsible for any delays caused by customs clearance processes or for any additional charges applied by customs authorities or delivery carriers outside of the United Kingdom.

If a customer refuses delivery, fails to pay applicable customs charges, or causes a shipment to be returned to Gym Gear, the customer shall remain responsible for any shipping costs, return shipping costs, storage charges, customs charges, or administrative costs incurred by Gym Gear. Any such costs may be deducted from any refund due.

Product Improvement Policy

Gym Gear reserves the right to change specifications, packaging or withdraw products in the interest of continuing product improvements. E. & O.E.
